{"id":15811,"date":"2024-04-22T17:37:14","date_gmt":"2024-04-22T15:37:14","guid":{"rendered":"https:\/\/labre.nl\/?p=15811"},"modified":"2024-04-26T13:31:55","modified_gmt":"2024-04-26T11:31:55","slug":"austria-changes-to-registration-fees-in-the-land-register-in-the-event-of-an-urgent-need-for-housing","status":"publish","type":"post","link":"https:\/\/labre.nl\/en\/2024\/04\/22\/austria-changes-to-registration-fees-in-the-land-register-in-the-event-of-an-urgent-need-for-housing\/","title":{"rendered":"Austria: Changes to registration fees in the land register in the event of an urgent need for housing"},"content":{"rendered":"\n<p>\u00a0<\/p>\n<p><span style=\"color: #f18101\">On 20.3.2024, the National Council adopted parts of the housing and construction package, according to which the Court Fees Act will be amended.<\/span><\/p>\n<p>In the event of an urgent need for housing, as well as under certain other conditions, purchasers can take advantage of the temporary exemption from the land register registration fee for homes up to an assessment basis of \u20ac 500,000.00, as well as from the lien registration fees of the same amount.<\/p>\n<p>The purpose of the amendment is to make the creation of housing <strong>more affordable<\/strong>.<\/p>\n<p>The conditions for claiming the exemption are:<\/p>\n<ul>\n<li>Existence of a legal transaction for consideration concluded <strong>after<\/strong> 31.3.2024,<\/li>\n<li>Receipt of the application for registration of the respective right at the Land Registry Court <strong>after<\/strong> 30.6.2024 and <strong>before<\/strong> 1.7.2026 (limitation of the fee exemption to two years),<\/li>\n<li>The building or structure must serve to satisfy an <strong>urgent housing need<\/strong>, and<\/li>\n<li>The fee exemption is claimed in the submission with reference to \u00a7 25a GGG.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>If the assessment basis exceeds \u20ac 500,000.00, registration fees must be paid to the extent exceeding this. From an assessment basis of 2 million euros, there is no longer any exemption from fees and the legal transaction is fully subject to the obligation to pay fees.<\/p>\n<p>The existence of the urgent need for housing must be proven to the land registry court both by submitting a confirmation of the main residence on the subject matter of the contract and by proving that the previous residential rights have been relinquished.<\/p>\n<p>If the right of ownership is relinquished within <span style=\"text-decoration: underline\">five years<\/span> or the urgent need for housing no longer exists, the exemption from fees will <strong>subsequently cease<\/strong> to apply.
